• What rent will I have to tender to secure the farm?

  Never an easy question to answer and a lot will depend on market conditions and the level of competing interest in the property Early professional advice is needed so that an appropriate tender can be made which is sustainable with reference to a detailed business plan and budgets.

• Are the letting terms reasonable?

  Consideration needs to be given to market norms and market conditions prevailing at the time of tender.

• What will be my liability in terms of insuring, maintaining and repairing the property?

  This should always be outlined in the letting particulars and tenancy agreement. The liability can only really be assessed by inspecting the property and considering the cost of complying with these obligations both at the time the tenancy is taken on and during the term.

• On what basis is the rent reviewed and what happens if I can’t agree the rent with the landlord?

  The basis of the rent review should be clearly outlined in the letting particulars and tenancy agreement. Rental disputes are often settled by an arbitrator or third party expert.

• What happens if I want to terminate the tenancy? Will I be entitled to any compensation for improvements etc.?

  The ability to terminate the tenancy and under what circumstances should be clearly addressed in the tenancy agreement along with the compensation provisions for which there is also some statutory protection.
